This will help you classify employees according to the correct exemption criteria, such as whether they are exempt from overtime pay. In addition, you should establish a consistent process for reviewing the performance of jobs that have historically required a lot of overtime to be completed. This can help you identify potential changes to the standard workweek or overtime pay rules that could have a significant impact on these roles.

Bridging the Gap: The Intersection of Technical and Functional Skills

Some staffing companies have policies in place that prevent their temporary workers from working more than 40 hours a week without the approval of their on site supervisor (or one of the company’s offsite supervisors). While these policies help to limit overtime, they do not mitigate your obligations under the FLSA. If your employees work overtime hours without supervisor approval, they must be compensated for these extra hours at the appropriate rate.
